Advertising Terms & Conditions
This Agreement between you and Selfix, s.r.o. (“Selfix”) consists of these Terms and Conditions. "You" or "Advertiser" means the entity identified in this enrollment form, and/or any agency acting on its behalf, which shall also be bound by the terms of this Agreement. Please read very carefully these Terms and Conditions.
You agree that your ads may be placed on (i) chameleonsubmitter.com web site (http://www. chameleonsubmitter.com) owned and operated by Selfix or (ii) Selfix reserves the right to, and in its sole discretion may, at any time review, reject, modify, or remove any ad. No liability of Selfix and/or its owner(s) shall result from any such decision. You agree that any ads promoting submitter, submitting tools or adult-hosting or such a related service will not be placed on chameleonsubmitter.com web site
1) Standard PolicyThe advertiser agrees that any information supplied in the advertisement is true, legal, honest, complete and accurate; that the advertiser is the owner of or is authorized to use the content of the advertisement. For advertisements, which contain the name or picture of persons, the advertiser has obtained the authority of such person to use the name or picture. The advertiser agrees not to submit or otherwise publish through this web site any information or material which breaches any contract or infringes any copyright, trademark, logos or any other personal or intellectual property or other right of any entity or person; is in breach of or violates any law in any country, or advocates any illegal activity. The advertiser shall indemnify Selfix against any loss, liability, damage and expense of any nature (including legal fees) arising out of the advertiser's breach of this Clause. The advertiser grants Selfix a non-exclusive, worldwide, perpetual, non-revocable license under its copyrights or other intellectual property rights, if any, to use, distribute, display and or reproduce such advertisements.
2 ) Payment
You agree to pay in advance the cost of the advertising. Selfix will not setup any banner ads campaign(s) unless the payment process is complete. Selfix may change its pricing at any time without prior notice. If you have an advertising campaign running and/or impressions stored for future use for any mentioned cause and Selfix changes its pricing, you'll not need to pay any difference. Your purchased banners fee will remain the same. Charges shall be calculated solely based on records maintained by Selfix. No other measurements or statistics of any kind shall be accepted by Selfix or have any effect under this Agreement.
3 ) Chargebacks
You agree that any and all chagebacks shall be determined as suspicious activity thus any and all details shall be included in a database which will be available for public access to anyone wishing to obtain details on a person conducting in suspicious activities and specialized agency will be contacted to reinvestigate this affair.
4 ) Technical Specifications
All advertisements should be submitted in GIF format with file sizes a maximum of 30k for banners (468wx60h pixels) and 30k for buttons (120wx60h pixels) in order to facilitate reasonable loading speeds. Other formats and sizes will be considered on an individual basis. Selfix will endeavour to accommodate all rich media formats but, due to the nature of the medium, these must be individually assessed and approved.
5 ) Limitation of Liability
Selfix may require any artwork, materials or information to be amended. Selfix may shorten the information provided. Selfix will not be held liable for any loss of photographs, copy, artwork or any other materials provided.
Selfix shall not be liable for any errors in content or omissions. Should an error appear in an advertisement, Selfix's liability will be limited to the cost of the advertisement.
Selfix reserves the right, for whatever reason, not to include any advertisement on the Site, nor will it be obliged to enter into correspondence regarding its decision. Selfix makes no warranty that the service will meet the objective, needs or requirements of the advertiser, nor that the service will be uninterrupted, timely, secure, or error free. Selfix does not make any warranty or representation as to the use or the results that may be obtained from the use of the service. Selfix makes no warranty that defects in the software will be corrected or that this site or the server that makes it available is free of viruses or other harmful components. No advice or information, whether oral or written, obtained by you from Selfix or through or from the service shall create any warranty not expressly stated therein. To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall Selfix be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service, from the cost of procurement of substitute goods and services, from any goods or services purchased or obtained or messages received or transactions entered into through or from the service, or from unauthorized access to or alteration of your transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangibles.
6 ) Renewal
Any renewal of the advertising contract will be at Selfix's sole discretion. The rates applicable to such renewal period (if any) are subject to change by Selfix from time to time in its absolute discretion.
7 ) No Assignment or Resale of Ad Space
The advertiser may not resell, assign or transfer any of its rights hereunder, and any attempt to resell, assign or transfer such rights will entitle Selfix to terminate the advertising contract immediately, without liability on the part of Selfix.
8 ) Miscellaneous
Selfix reserves the right to make changes to this agreement at any time. Selfix also reserves the right to modify or discontinue the Service, temporarily or permanently, without notice to you. You agree that Selfix shall not be liable to you or any third party for any modification to or interruption, suspension or termination of the Service. Nothing under these Terms and Conditions limits Selfix's liability for any fraudulent statement or for personal injury or death caused by Selfix's negligence. If any provision of the Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of the Terms and Conditions and the remainder of the provision in question shall not be affected.
